No, you should not sue YET. The reason for this is that some States have very specific rules about dual cases - where a civil suit and a criminal prosecution cover the same matter and are overlapping in time of filing. Wait for the criminal prosecution of her to finish, and file suit the day after. If she is convicted, you have pretty much won your lawsuit, and your lawsuit will be MUCH cheaper. Also, you will probably get Restitution if she is convicted. You should consult with a private attorney in your area, but let them know that there is a possibility of pending criminal prosecution. The rules may be different for your State, and you must follow the rules of your State.
